Guest Policy

The Julie Anna Inn (Inn) strives to provide an environment free from sexual harassment, discrimination, aggression and bullying. The Inn will not tolerate sexual harassment, discrimination, aggression or bullying. They are against the law and create a risk to physical and psychological health and safety of guests, visitors, and Inn staff.


Guests and visitors must not engage in sexual harassment, discrimination, aggression or bullying.



Application of this Policy

This Policy applies to guests of, and other visitors to, the Inn, in all interactions and communications, whether they be in person, online, or on the phone.



Failure to comply with this Policy 

Failure to comply with this Policy may result in:

• refusal of service by Inn staff;

• removal from the Inn and potential refusal of future entry;

• Police intervention; and/or 

• individual liability for your own actions under applicable legislation, which could include criminal liability.



Obligations under this Policy

Guests and visitors are required to understand, familiarise themselves with, and comply with this Policy.



Sexual Harassment

A person sexually harasses another person (person harassed) if:

• the person makes an unwelcome sexual advance, or an unwelcome request for sexual favours, to the person harassed; or

• engages in other unwelcome conduct of a sexual nature* in relation to the person harassed,

in circumstances in which a reasonable person, having regard to all the circumstances, would have anticipated the possibility that the person harassed would be offended, humiliated, or intimidated.


*Conduct of a sexual nature includes subjecting a person to any act of physical intimacy, making a statement or remark of a sexual nature to a person, or in the presence of a person, whether the statement is made orally or in writing, and making a gesture or action or comment of a sexual nature in a person’s presence.


The intention of the alleged sexual harasser is irrelevant. What is important is whether a reasonable person would have expected the possibility that the other person would be offended, humiliated or intimidated by the conduct (reasonable person test). What is acceptable to one person may not be acceptable to another.


It is also unlawful to have an environment that is hostile on the ground of sex. This includes where conduct is not directed at a particular person, but still creates a sexually hostile environment. The reasonable person test applies. Conduct that subjects someone to a sexually hostile environment can include making one sex feel uncomfortable or excluded.


Some sexual harassment is criminal, such as such as assault, indecent acts or exposure, stalking, voyeurism, engaging in obscene communications, and engaging in image-based abuse. 



Discrimination

Discrimination is when a person, or a group of people, is treated less favourably than another person or group because of their background or certain personal characteristics or features.


It is also discrimination when an unreasonable rule or policy applies to everyone but has the effect of disadvantaging some people because of a personal characteristic they share.


Guests and visitors must not discriminate against anyone because of their attributes, characteristics or features, including their:

  • race;
  • colour;
  • sex;
  • sexual orientation;
  • age;
  • physical or mental disability;
  • marital status;
  • family or carer's responsibilities;
  • pregnancy;
  • religion;
  • political opinion;
  • national extraction (such as heritage, citizenship, where their parents were born);
  • social origin;
  • breastfeeding;
  • gender identity; and
  • intersex status. 


Some discrimination is criminal.



Aggression and Bullying

Aggression and bullying includes behaviours such as:

  • being violent, forceful, or intimidating;
  • using abusive or offensive language;
  • making threats of violence and engaging in violent acts;
  • mocking or humiliating someone; 
  • holding ‘initiation ceremonies’;
  • teasing or playing jokes on someone;
  • unfairly criticising someone; and/or
  • harassing someone.


Some of these behaviours are criminal.



Reporting breaches of this Policy

Breaches of this Policy must be reported to Inn management or via email to [email protected] immediately.
